Reporting Copyright Infringement
How to submit a DMCA notice.
If you believe that material available on this website infringes a copyright that you own or are authorized to enforce, please send a written notice to the Copyright Contact listed on this page. To help us evaluate and respond to your notice, it should include the following information:
- A physical or electronic signature of the copyright owner or a person authorized to act on the copyright owner's behalf.
- Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works are covered by one notice, a representative list of those works.
- Identification of the material claimed to be infringing or the subject of infringing activity, together with information reasonably sufficient for us to locate it, such as the specific page URL.
- Your name, mailing address, telephone number, and email address.
- A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act on the copyright owner's behalf.
Notices that do not substantially include the information above may not be sufficient for us to identify or address the claimed infringement.
Our Response
What happens after a notice is received.
When Capitol Real Estate receives a complete and credible copyright notice, we may investigate the claim and, when appropriate, remove or disable access to the identified material. We may also notify the person who provided or posted the material so that person has an opportunity to respond.
Capitol Real Estate reserves the right to remove content at any time when we believe removal is appropriate, including when content may infringe intellectual property rights or violate applicable law or website policies.
Counter-Notice
If content was removed by mistake.
If you believe material you provided was removed or disabled because of mistake or misidentification, you may send a written counter-notification to the Copyright Contact. A counter-notice should include:
- Your physical or electronic signature.
- Identification of the material that was removed or disabled and the location where it appeared before removal or disabling.
- A statement under penalty of perjury that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification.
- Your name, address, and telephone number.
- A statement that you consent to the jurisdiction of the appropriate United States Federal District Court as provided by 17 U.S.C. § 512(g), and that you will accept service of process from the person who submitted the original infringement notice or that person's agent.
After receiving a valid counter-notice, we may restore the material in accordance with applicable law unless the original complaining party notifies us that it has filed an action seeking a court order concerning the material.
Good-Faith Notices
Please submit accurate information.
Copyright notices and counter-notices are legal communications. Knowingly making a material misrepresentation that content is infringing, or that content was removed or disabled by mistake or misidentification, may result in liability under applicable law. You may wish to consult an attorney before submitting a notice or counter-notice.
Repeat Infringement
Respect for intellectual property.
Where appropriate and in circumstances within our control, Capitol Real Estate may restrict or terminate access for users who repeatedly infringe the copyrights or other intellectual property rights of others.
